Terms of Service

These Terms of Service ("Terms") govern your relationship with the zeitclaim application (the "Service") operated by Stefan Joschko - van Ackern (Sole Proprietorship in formation, collectively, "Stefan Joschko - van Ackern", "us", "we", or "our").

Please note: zeitclaim is currently in beta and provided as a free service. The Service may change, be discontinued, or transition to a paid model in the future. We appreciate your understanding as we develop and improve the Service.

By accessing or using the Service, you agree to be bound by these Terms. We may update these Terms from time to time. Changes will be posted on this page with an updated date. By continuing to use the Service after changes are posted, you agree to be bound by the updated Terms.

1. Use License

zeitclaim is currently provided as a free service in beta. We reserve the right to modify features or introduce paid plans in the future. If we introduce paid plans, we will update these Terms and notify users accordingly.

Beta Service Limitations: As a beta service, zeitclaim may experience service interruptions, data loss, or significant changes to features. We do not provide any service level agreements (SLA) or uptime guarantees during the free/beta period. You use the Service at your own risk during this period.

AI Feature Availability: AI-powered features (including those provided by OpenAI and Baseten) may experience interruptions or unavailability. We do not guarantee continuous availability of AI-powered features, and they may be temporarily unavailable due to third-party service issues or maintenance.

2. Accounts

When you create an account, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of these Terms.

You are responsible for safeguarding your password and all activity under your account. You agree not to disclose your password to any third party and to notify us immediately of any unauthorized use of your account.

3. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable laws or regulations
  • Attempt to interfere with or disrupt the Service or servers
  • Use automated means to access the Service without permission
  • Impersonate any person or entity
  • Transmit any viruses, malware, or harmful code

4. Content and Data

Our Service allows you to store, share, and manage calendar and time-tracking data ("Content"). You are responsible for the legality, reliability, and appropriateness of any Content you provide.

By using the Service, you grant us a license to process, store, and display your Content solely for the purpose of providing the Service to you. You retain all ownership rights to your Content.

Time Management and Calendar Disclaimer

zeitclaim is a tool to help you organize and understand your time. We do not verify the accuracy of any time-tracking, billing, or financial data you enter or that the Service generates. You are solely responsible for verifying all information before using it for invoicing, billing, or other business purposes.

We strongly recommend reviewing all AI-generated suggestions and data before relying on them for business decisions.

5. Intellectual Property

The Service and its original content (excluding Content provided by users), features, and functionality are and remain the property of us and our licensors. Our trademarks and trade dress may not be used without prior written permission.

We claim no intellectual property rights over the data you provide to the Service. Your content remains yours.

6. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us at info@zeitclaim.com and requesting account deletion.

When you request account deletion, your data will be removed from our systems as soon as practicable, typically within 30 days from active systems and 90 days from backups.

7. Limitation of Liability

To the maximum extent permitted by law, we and our affiliates, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

  • Loss of profits, data, or goodwill
  • Business interruption
  • Loss of revenue or anticipated savings
  • Errors in AI-generated suggestions or content
  • Any use or inability to use the Service

This limitation applies even if we have been informed of the possibility of such damage and even if a remedy fails of its essential purpose.

8. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be secure, timely, uninterrupted, or error-free
  • AI-generated content will be accurate or suitable for your needs
  • AI-powered features will be continuously available or free from interruptions
  • Any defects will be corrected
  • The Service is free of viruses or harmful components
  • The results will meet your requirements

9. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany, without regard to its conflict of law provisions.

For users outside Germany: By using the Service, you agree that German law governs these Terms and any disputes arising from your use of the Service. You consent to the exclusive jurisdiction of the courts in Essen, Germany, for any disputes that cannot be resolved through the dispute resolution process described below.

For US users: You expressly waive any objection to venue in the courts of Essen, Germany, and agree not to plead forum non conveniens.

10. Dispute Resolution

Informal Resolution: Before initiating any formal dispute proceeding, you agree to first contact us at info@zeitclaim.com and attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days from the date of your initial contact.

EU Consumers: If you are a consumer in the European Union, you may also make use of the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. As a beta service, we may make changes to reflect service updates, improvements, or legal requirements. Changes will be posted on this page with an updated date.

By continuing to use the Service after changes are posted, you agree to be bound by the updated Terms. If you do not agree with any changes, please stop using the Service and contact us to delete your account.
